  • The submission to such conduct is either explicitly or implicitly a term or condition of an individual's employment.
  • Submission or rejection of such conduct by an individual is the basis for employment decisions affecting such individuals.
  • Such behaviour has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.

Bullying is considered to be harmful behaviour that is unwanted and persistent. It can take the form of physical, verbal, or social behaviour. It can be characterized by an intent to harm on a peer-to-peer basis. Under Title VII of the Civil Rights Act, it is illegal for employers to discriminate against employees based on sex, race, colour, and religion regarding wages and benefits, change a condition of employment without notice, or terminate an employee without good cause.
